The following definition shall apply within this document:

‘The Company’ shall mean Mobile Video Editing, its staff and representatives.

‘The Facilities’ shall mean any services provided by Mobile Video Editing.

‘The Client’ shall mean the person(s), company or firm booking or using any service provided by Mobile Video Editing.

A written order is required in advance to confirm a booking of any of The Facilities; this may be sent to The Company e-mail which is info@mobilevideoediting.co.uk If written confirmation is not received, the time booked cannot be guaranteed. The Company shall not be liable for the consequences of any inaccuracies or misunderstandings caused by The Client failing to confirm the booking in writing, or for correspondence being lost in the post.

Credit facilities may be made available after the processing of completed application forms. If credit facilities are granted, settlement will be required within 30 days of invoice date. This does not imply settlement is acceptable at the end of the month following the invoice date. The credit arrangement may be withdrawn if payments are regularly received late. Should the balance of the account reach any credit limit agreed prior to payment of the account being due, further booking of The Facilities may be refused, and in any event will be payable prior to use.

In the event that these terms are exceeded and payment is not forthcoming, The Company reserves the right to suspend availability of The Facilities and place the account in the hands of collection agents for recovery of the sums involved, together with any costs and interest incurred by such action.

The Company reserves the right to retain any and all material in its possession against failure to make payment of its invoices.

At The Company’s discretion, any special offers or introductory rates offered by The Company are wholly dependent on the account in question meeting all of the above conditions. In the event that this is not the case, any special offers or introductory rates may be withdrawn until such time as the account does meet the above conditions.

If credit arrangements have not been made, or other arrangements agreed, settlement of all charges will be required at the end of the session. Otherwise, edit masters and/or graphics rolls and/or duplication will be retained until settlement is received. Edit masters and/or graphics rolls and/or duplication may also be retained whilst a cheque is being cleared by our bankers.

A standard day is regarded as a continuous period of 10 hours, commencing at 0900hrs and completing at 1900hrs. Unless stated otherwise in The Company’s published rate card, the minimum booking is 2 hour at Mobile Video Editing or 4 hours on site and all bookings are charged in ½ hour increments. All hours worked beyond 1900hrs unless explicitly agreed in advance are at the discretion of the editing/graphics staff. No hours will be worked beyond 2400hrs unless these have been arranged prior to the commencement of the session. The hourly rate will be charged for any additional time required, and also for non-continuous periods of booking. A standard 10 hour day is charged at 10 times the hourly rate. Duplication, dubs, copies etc. are charged separately from and outside of editing/graphics time.

The Company reserves the right to charge a cancellation fee if cancellations are made later than 48 hours from the start time of the booking. Bookings canceled within 48hrs will be subject to a charge of 25% of the total booking value. Bookings canceled within 24hrs will be subject to a charge of 50% of the total booking value.

Any dispute relating to an invoice or to work completed must be raised within 10 days of date of the invoice.

Tapes and other goods whilst on the premises are to be insured by The Client. The Client uses unique or original material at his entire risk. The Company will not under any circumstances accept liability for any loss or damage to this material. If The Company is requested to send tapes or goods by courier or by post on behalf of The Client, responsibility for their safety belongs to The Client at all times.

The Client shall indemnify The Company against any losses or expenses arising from any claim by a third party or breach of copyright or defamation relating to any work carried out for The Client by The Company. The Company may refuse to carry out work on what appears to be copyrighted material.

The Client shall remove all of his materials from the premises of The Company within 3 months of the date of the most recent invoice relating to work on these materials, unless agreed in writing by The Company. Thereafter the said materials shall become the property of The Company who shall dispose of them.

Rates are subject to change without notice, and all prices are subject to VAT at the current rate.

The Company reserve the right to use their discretion with respect to variance of any or all of the above conditions.
